Content Clearances
Creating a website
necessarily means the incorporation of content onto the
site. Content clearances are designed to make sure the
use rights surrounding such content are in order.
A website is many things. From a legal
perspective, it is a collection of intellectual
property rights. If there is a domain, is there a
trademark issue involved and, if not, has it been
trademarked to protect it? If there is a logo, has the
same trademark analysis been done? What about the site
design and actual content? Is it original or borrowed
from some other source? If borrowed, has a license to
use the content been arranged?
A content clearance is simple a legal effort
to make sure a website is not infringing upon the
rights of another party. Well, that is the dry legal
reason for obtaining the clearance. The real, practical
reason is to avoid getting sued by some other site or
company for using their intellectual property without
the right to do so.
As you can probably guess, I provide content
clearance services. The clearance covers pretty much
everything on your site from domains to still
photographs to written content to logos to videos and,
well, you get the idea. I then prepare a report for you
detailing each of the relevant areas, any potential
concerns and possible solutions. The goal is then to
clean up any loose ends.
The web is not nearly as wild as it used to

that there are law firms out there whose sole purpose
is to hunt the web looking for people using the
intellectual property of their clients without
permission. They then file lawsuits for millions of
