Affiliate Evolution
Let me be blunt. Super affiliates tend to
leave themselves open to all kinds of legal problems
because they, well, started as simple affiliates at one
point. When anyone starts with affiliate marketing,
they usually just fly by the seat of their pants
because there is little risk in doing so. As you grow
into a more powerful force on the web, that changes and
you need to start acting like a real business to
maximize your earning and limit your risk.
Due Diligence
To be a super affiliate, you need to form
business relationships with others online. In doing so,
however, you should also leverage your position while
making sure to protect yourself at the same time. Let's
look at an example.
Let's say you've built a large mailing list
that you email to. You make money by sending out offers
from providers to the list and are then compensated for
any resulting sales, to wit, the classic affiliate
relationship. Well, are you complying with FTC
regulations when you do the mailing? Most mailers will
send out an article about how they like the product or
service, but don't reveal their business relationship
with the company behind it. This is a huge FTC
violation.
Then what about the amount of compensation
you are being paid from the company? You are going to
produce a lot of business for that company. They should
pay you a much larger cut for the business than they
are for an affiliate that sends a few sales a month.
The only way you are going to get this is to ask for
it. If the company will not agree to a higher payout,
it is time to talk to their competitors. Never
undervalue yourself as a super affiliate! Traffic is
king. If you have it, you rule the roost so act like
it.
Site Issues
As a super affiliate, you probably have
sites bringing in large volumes of traffic. If so, you
need to get into compliance with the various state and
federal laws that govern websites. A site that has 10
visitors a day has a low risk of being sued because
almost nobody visits it. A site that gets 5,000
visitors or more a day has a much greater risk.
Documents like terms, privacy policies, earnings
disclosures and so on are needed. Failure to comply
with them is asking for trouble.
