What are the assets of your business? It may sound like a strange question given the title of this page, but it is an apt one. Most business owners will list their hard assets such as products, machines, furniture, computers and so on. Few think of the less tangible, but highly valuable assets known as intellectual property. 

Picture in your mind a swoosh logo. What immediately comes to mind? The Nike company and brand. The swoosh is a form of intellectual property, and a very valuable one. How much do you think a new company would pay to be able to use it on their clothing line? A ton. This is a process known as licensing and it produces millions upon millions of dollars of revenue for companies and personalities alike.

Trademarking is one way to nail down and protect your intellectual property. Trademarking protects the name or identifying mark of something. A trademark protects the identifier of a product. A service mark protects the identifier of a service. A trade name application protects the name of a company. Your company will need at least one of these protections, but it is more likely it will need a combination of them. 

I provide trademark application services for new and old, small and big businesses alike. The process involves picking a name, identifying the market you will be focusing on and then performing trademark searches to see if anyone else has registered it or something close to it from which a claim of infringement could be made. This is something we want to avoid. 

Once the name is cleared, I will then prepare and submit the trademark application for the federal register. The agency in charge of the approval process is underfunded and overworked, so it will often take up to a year or longer for the application to be approved or rejected. Much of this time involves simply waiting for a response from the agency, but there is also a bit of back and forth with the trademark office lawyers over the nature of the application.
